WURTHY AND PARTICIPATING SELLERS COVERED COMMUNICATIONS DISCLOSURE STATEMENT AND CONSENT


Please read the disclosures below and provide your consent to receive from us in electronic form a Retail Installment Contract and any other documents, notices, disclosures, billing statements or other information or communications required by applicable law to be provided or made available to you in writing (i.e., in paper form), if any (collectively, “covered communications“). You may choose not to provide consent to receive covered communications in electronic form, but if you decline to do so, you will not be able to apply for or obtain financing from a participating seller by using the Wurthy application (the “App“). All information and communications not required by law to be in paper form are not covered by this disclosure and consent, and instead are subject to [to be discussed and added: this should be language included in the App flow or App Terms of Use that generally provides that non-covered communications are sent electronically without any ESIGN limits; see comment below]. You do not have a right to receive any covered communication in paper form. We reserve the right to send any covered communication in paper form without waiving or cancelling your consent. The words “youv and “your“ mean the person receiving these disclosures, and the words “we,“ “us“ and “our“ mean Wurthy, Inc, and its affiliates, successors and assigns as well as each participating seller from whom you may request financing through the App.


  • To receive covered communications electronically, you will need:
    • A functioning personal computer, tablet, smart phone or other electronic device (a “device“);
    • A connection to the Internet and an e-mail account;
    • A current version of an Internet browser that we support that includes 128-bit encryption with [JavaScript and] cookies enabled, including Google Chrome [consider adding other browser examples];
    • A current version of a software program that accurately reads and displays PDF files, such as Adobe Acrobat Reader; and
    • Operating system software that will support the foregoing.
  • In order to retain and/or print covered communications sent to you electronically, your device will need to be able to save and store covered communications, including having sufficient storage capacity, and/or you will need a functioning printer connected to your device.
  • You may withdraw your consent to receiving covered communications electronically by contacting us at [e-mail address or toll free telephone number for contacting Wurthy to revoke consent and other actions noted below to be added], but such withdrawal will result in [consequences of withdrawal, if any, to be discussed and added; see comment below]. (Please note that you may still receive covered communications from us electronically until we have processed any withdrawal of consent.)
  • You may request a paper copy of a covered communication that was sent electronically by contacting us at [to be added]. [Copies will be provided at no charge.][There will be a charge for each copy.]

By checking this box as your electronic signature, you acknowledge that you have read and agree to Wurthy’s disclosures, confirm that you satisfy the hardware and software requirements referenced, and consent to receive covered communications in electronic form.
